Another Victory Brings Hope to Rev. Roger & Share Christie of THC Ministry

Roger & Share Christie are the founding Reverends of "The Hawaii Cannabis Ministry".

Reverend Roger Christie has been in federal custody for 3 1/2 years.

(COTTAGE GROVE, Ore.) - The THC Ministry in Hawaii was raided more than 3 1/2 years ago by federal authorities. Both Roger & Share Christie and a dozen congregation members were arrested. Most were released within hours, including Reverend Christie's wife Share, but the Reverend Roger Christie has been federally detained since the arrest.

The allegation is that, as a promoter of "marijuana sacrament" and his religious teaching that include cannabis as sacrament, Christie himself is a threat to Hawaiian society.

On the 20th of September 2013 Case CR No. 10-00384LEK was called to order in federal court by Judge Leslie E. Kobayashi on behalf of the US Government to be heard and addressed. This case is: the United States Government -vs- Roger Cusick Christie and co-defendant Sherryanne "Share" Christie, regarding the Christie's right to use "Entrapment by Estoppel" as part of their defense.

The Christie's filed their memorandum of Opposition on the 10th of September 2013, and followed it with a "Fed R Crim P. 12.3" as well, which is a notice of their intent to rely on the defense of "Entrapemtn by Estoppel" at their trial, based upon statements made to them between 2001 & 2005 by the (then) Hawaii US Attorney Edward Kubo, and also by DEA Special Agent Jesse Fornay.

Below are the 5 points which the judge had to say and therefore meaning, the court has decided and ruled:

  1. "The Court finds that factual issues exist as to whether and what representations were made to Christie, and that these issues may pose credibility questions for the jury to resolve."
  2. "The Court notes that "[a] defendant ‘has the right to have a jury resolve disputed factual issues. However, where the evidence, even if believed, does not establish all of the elements of a defense, . . . the trial judge need not submit the defense to the jury.’"
  3. "Further, as to statements allegedly made to Christie by state and county officials, the Court rules that Christie must first, outside the presence of the jury, make a showing of relevance to his prima facie case for his defense of entrapment by estoppel before this Court will permit the testimony to be presented to the jury."
  4. "The Court finds that she raises a defense of entrapment by estoppel, and bases this defense on the Federal Officials’ and various state and county officials’ statements, as relayed to her by Christie. St. Cyr bears the burden of proving entrapment by estoppel."
  5. "Although both Christie and St. Cyr admit that Christie -- not the Federal Officials or state and county officials -- relayed the alleged erroneous advice to her, the Court finds that, as a matter of law, St. Cyr has made a prima facie showing to raise this defense because the scope of the representation made by one of the Federal Officials allegedly referenced both Christie’s and the Ministry’s use of marijuana."

Now, in addition to this wonderful news, the judge also had this to say as she made her final statement:

"The Court respectfully reminds the parties that this is merely an outline of its decision, and that a full order shall be filed. IT IS SO ORDERED."

This reporter feels that this ruling and opportunity, along with the actual Living Torah itself that Christie so powerfully revealed to the world short before his arrest (on YouTube), and all the other factual cards to be played in their favor, that the Christie's will soon find their way to the freedom and reunion with one another they've deserved and have waited patiently for since this tragedy of injustice against them began.
