Marijuana Extracts NOT FOR SALE! (Yet) for 21+ in Oregon

OMMP must draft rules before stores may sell products to the recreational market.

(SALEM, Ore.) - On Tuesday, Oregon Governor Kate Brown signed a bill that allows anyone 21 and older to buy cannabis (marijuana) extracts and pot-infused edibles from Oregon dispensaries. However, the Oregon Health Authority added that it must draft rules for the sale of extracts and edibles before stores may sell them to recreational users.

In the 2016 Legislative Session, the Legislature passed HB 4014, SB 1511 and SB 1598 that made changes to the Oregon Medical Marijuana Act. This provision is part of Senate Bill 1511, which also allows recreational pot shops to sell tax-free medical marijuana to patients.

The Oregon Medical Marijuana Program (OMMP) anticipates having temporary rules ready by early April, 2016, but that date is tentative. The OMMP must develop and file temporary rules before any of the legislative changes can be implemented. NO SALES of extracts, oils and edibles to recreational clients can take place until then.

Though Gov Brown’s signing of the bill lead many to believe otherwise, medical marijuana dispensaries may not begin selling single-serving, low-dose cannabinoid edibles, and pre-filled receptacles of cannabinoid extract to adult-use retail consumers until OHA has adopted the new, temporary rules.

Some of the changes that will require OHA to issue temporary rules or amend current rules include:

HB 4014

  • Removal of residency requirements for growers, dispensaries and processing sites.
  • Issuance of a temporary receipt upon submission of a complete application for new patients.
  • Reduction of the patient fee for veterans to $20 with proof of having served in the Armed Forces of the United States.
  • Remove limit on number of patients at a grow site address, subject to plant count limits.

SB 1511

  • Expansion of early retail sales to include the sale of one single-serving low dose edible and sale of one prefilled receptacle of an extract to a retail customer per day.
  • Stay on plant count limits for growers that have applied to OLCC and for growers that have not applied to OLCC. See SB 1511, section 21(4), which indicates that OMMP shall adopt rules to implement the expansion of early retail sales.

SB 1598

  • Allow a patient or caregiver to provide marijuana to a processing site and for the processing site to transfer the products made back to the patient or caregiver.
  • Allow a person to be designated to report inventory for all growers located at a grow site.
  • Allow OHA to adopt rules to implement non-profit dispensaries.

So, when is the OLCC going to limit how many bottles of liquor a person may purchase in any given day ?

The OLCC is being misleading. They need to clarify that extracts and edibles are not concentrates and tinctures. Extract= BHO/CO2 oil Edible= Food or Potable Liquid Concentrate= Kief, RSO/alcohol, Capsules, Tinctures, or anything that is not extracted with a non-polar hydrocarbon, pressurized CO2, or food/drink. https://www.oregon.gov/oha/mmj/Documents/Rulemaking/333-007-0210-table-1.pdf Also, SB151 does specify how edibles and extracts are to be sold. 1, 5mg edible per person per day 1, 250mg receptacle of extract per person per day (e) The medical marijuana dispensary sells no more than one single-serving, low-dose unit of limited marijuana retail product to the person per day if the person is purchasing a cannabinoid edible; and (f) The medical marijuana dispensary sells no more than one receptacle of limited marijuana retail product to the person per day if the person is purchasing a prefilled receptacle of a cannabinoid extract. The Bill dose not say the Authority is to halt sales while crafting a rule at any point after passing this bill. It says that the Authority can implement new rules which the industry must comply with. https://olis.leg.state.or.us/liz/2016R1/Downloads/MeasureDocument/SB1511 EMERGENCY CLAUSE SECTION 36. This 2016 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2016 Act takes effect on its passage.
