(SALEM, Ore.) - Attorney General John Kroger today announced the indictment of a Lincoln County prosecutor on charges that he attempted to use his position to obtain sexual favors. “Government officials must be held to the highest standards,” said Attorney General Kroger. “Prosecutors wield great power and must not abuse it.” Rand Eugene Overton (58), a Lincoln County Deputy District Attorney, was indicted Thursday on four counts of official Misconduct in the First Degree and two counts of Attempted Coercion. A criminal indictment is merely an allegation. Every criminal defendant is considered innocent until proven guilty beyond a reasonable doubt in a court of law. Assistant Attorney General Dan Wendel is prosecuting the case for the Oregon Department of Justice. Attorney General John Kroger leads the Oregon Department of Justice. The Department's mission is to fight crime and fraud, protect the environment, improve child welfare, promote a positive business climate, and defend the rights of all Oregonians. Overton's comment was definitely inappropriate but this is something that should be handled by discipline from his employer and the Oregon State Bar. If she was harmed by the comment, she could also sue but c'mon man, up to a YEAR in jail ? He clearly misread what he perceived to be a signal. He was wrong but what he did does not warrant criminal prosecution. Is this the type of law enforcement my tax dollars are paying for ? If so, I don't want to pay for it. Someone in Salem needs to get his priorities straight. This guy just needs counseling not jail.
Editor: I'm sorry, but I saw the redacted brief on this and there are numerous charges. You think someone in a trusted position charged with enforcing the law should not face his peers and simply see what happens? Didn't he create these circumstances? We write frequently about the problems from cops sticking together, but John Kroger was a Marine, and he doesn't apparently overlook crimes because the person is another officer of the courts. Regarding this case, I should probably publish more of this, you might feel differently. I just reserve a particular contempt for those who roam in the halls of hypocrisy; cops, prosecutors, teachers and clergy man, and live illegal lives. I'm sure you agree.
