What First Amendment?

The "Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010" is a reincarnation of the failed, freedom stripping political acts of the Bush era.

(SALEM, Ore.) - Two of the most jaded, misdirected and agenda driven politicians in America, Joe Lieberman and John McCain, have introduced a bill to further the non-humanitarian arrest, detention and prosecution of individuals suspected to be 'enemy belligerents' who are believed to have engaged in hostile activity toward the United States.

But what exactly is hostile activity?

One stated target in the act is a person who, "has purposely and materially supported hostilities against the United States or its coalition partners."

Maybe McCain forgets that North Vietnam pulled this trick on humanity. U.S. pilots and ground forces captured during that war were considered 'war criminals' and in the view of the Communists, they did not deserve to be viewed as Prisoners of War, who under the Geneva Convention, are to be afforded numerous rights. North Vietnam was a signatory of the Third Geneva Convention of 1949.

Instead of just violating the rule for POW's, they classified them as something else. Our term for that today is "enemy belligerent". Of course don't forget "terrorist". One unique aspect of the McLieberman burger is that the likely arrest candidates will be Arab or American. The daily terrorism of Israel toward Palestine is apparently still A-OK.

An endless list of informational links and other data is sent to me all day every day. Some of the information we publish compromises the weak and illegal members of the U.S. government; like the story of Marine Col. Jim Sabow whose murder in 1991 was and still is passed off as a suicide. His fatal error? Discovering that illegal drugs were being funneled through his base, and threatening to bring down the house over it.

Right now, at this moment, the federal government is trying to figure out what to do about things like this getting out on the Internet. They know we are connected with major sources of information. Will we be a target of the McCain/Lieberman "Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010"?

Could this new legislation by the Israeli Senator and the one who made movies for the North Vietnamese really be a sign of the worst possible kind?

I believe the answer is yes. Americans are guaranteed certain rights under the Constitution, but not under the "new program" by McCain and Lieberman.

SEC. 5. DETENTION WITHOUT TRIAL OF UNPRIVILEGED ENEMY BELLIGERENTS

"An individual, including a citizen of the United States, determined to be an unprivileged enemy belligerent under section 3(c)(2) in a manner which satisfies Article 5 of the Geneva Convention Relative to the Treatment of Prisoners of War may be detained without criminal charges and without trial for the duration of hostilities against the United States or its coalition partners in which the individual has engaged, or which the individual has purposely and materially supported, consistent with the law of war and any authorization for the use of military force provided by Congress pertaining to such hostilities."

We lost rights under Bush that we could never get back. It is all a backlash of the 9/11 scandal, which, again to the government's great irritation, we have written about time and time again. In fact the last story I published was about 9/11. I used to write one every six months or so, now it is becoming weekly. Now the scandal is showing up on the radar of national media.

Our news group does its job; we are the critical watchdogs of government, the environment, business and the military. I wonder if this act will be used to undermine our most basic and essential rights. This act is more Orwellian crap; the stuff that the more edgy Internet crowd may very well may ultimately be compromised by.

Rebel News noted that the act was introduced Thursday with little fanfare. Sounds oddly reminiscent of the behavior in Washington during the Bush era when they gave the first round of our rights away[1].

In this act there is no distinction between U.S. citizens and non-citizens, and states that "suspected belligerents" who are “considered a "high-value detainee" loses their Miranda Rights. Fascism at its finest, but with Republicans like this, (I know, I know, but you do too) we don't need any belligerent enemies. These characters are destroying America from within, that only requires politician/terrorists, which we have plenty of in this country.

INAPPLICABILITY OF CERTAIN STATEMENT AND RIGHTS

"A(n) individual who is suspected of being an unprivileged enemy belligerent shall not, during interrogation under this subsection, be provided the statement required by Miranda v. Arizona (384 U.S. 436 (1966)) or otherwise be informed of any rights that the individual may or may not have to counsel or to remain silent consistent with Miranda v. Arizona."

The way the legislation is written suggests that the President and the Executive Office will oversee all detention and interrogation. Yet, when you look more closely, you see that these policies can be used by everyone from the feds to Barney Fife.

(2) UTILIZATION OF OTHER PERSONNEL

"A high-value detainee interrogation group may utilize military and intelligence personnel, and Federal, State, and local law enforcement personnel, in conducting interrogations of a high-value detainee. The utilization of such personnel for the interrogation of a detainee shall not alter the responsibility of the interrogation group for the coordination within the Executive Branch of the interrogation of the detainee or the determination of status and disposition of the detainee under this Act."

So this is basically a new tool to allow your government to behave more like Israel's, where midnight raids see fathers, mothers and sometimes children disappear into the middle of the night. This is what McCain and Lieberman both want for America. If they somehow are able to see this become a law, I hope those two bastards are the first to be arrested.

Seems that anything that is passed must be done with the majority power and signed by the president. So which party is that? You need not answer, I believe all voters out there know, and if they don't, what kind of voter must they be? When the Patriot Act was passed (which Obama recently renewed on a weekend evening), there was much grumbling about the future loss of privacy and other rights. I do recall that unfortunate Oregonian who went to detention because of bad info sent from Spain. This event became transparent, there were apologies and a remuneration took place. Otherwise the average law abiding citizen really has no serious problems with their "rights" being diminished because of this act during this time of war. Anyone look at their Credit Report and see all the civilian organizations that look you up? Has the Patriot Act made us safer? Just look at the timeline of events since 9/11 and see what happened and who was in power. The Sedition and Treason Act during WWII was quite restricting compared to anything now, and if it was in place now, then there would be many people being held if you compare the "then" with the "now" as to what has been in the media. So, yes, we have considerable freedom, much greater than in our past, and far more than any other nation on earth engaged in war. The citizens are simply not privy to what our intelligence services have, nor should they be. Long ago they learned to keep the media out of the loop, except for when they wanted specific news leaked out.
