(SALEM) - The man accused of hitting a critically injuring a Salem school bus driver faced a Judge for the first time Friday. 20-year old Corey Duffield faces charges of felony hit and run and assault, while 65-year old Gary Phillips remains in critical condition at Salem Hospital. According to court records, Duffield said he was on his way to work, and hit Phillips in the crosswalk at the Hawthorne Ave and D Street intersection. He said there was a yellow light, he was traveling at 40 mph in a 35 mph zone, and it was dark, rainy, and foggy at the time of the accident. The Judge set Duffield’s bail at $70,000. If Duffield posts bail, he will be required to live with his mother until his next court appearance. He will be back in court on Feb. 9th. An account has been established to assist Gary Phillips, the Salem-Keizer school-bus driver who was critically injured in a hit and run accident this week. People wishing to donate may do so at any Key Bank, by donating to the Gary C. Phillips donation account. "Gary has major head trauma, that only God can repair," said Linda. "We ask for everyone's prayers." Linda is grateful that both parents of the young man accused in the incident have reached out to her and her family. "There are tragedies on both sides," said Nelson, speaking about how difficult this situation has been for both families. KM et: This old reporter (no joke !)"been there" in court, was GrndJury foreman (twice), well aware...that's why felt time ripe to see victim gets entire amount, not bond-seller at percentage... Then court collects from perpetrator via power of the law and police enforcement. "Painful consequence" in work, practically...

Although the idea of giving $70,000 to the victim is a great idea in reality in order to post bail the perpetrator only has to come up with 10% of that which is paid to the bond company to hold in trust to guarantee the suspect shows up in court.

Perhaps a perceptive representative assembly some day may simply assign that sum of $70,00 established as "bail" for transfer to benefit of legitimate victim. If perpetrator, perhaps caught in un-caused situation, can afford bail, surely that same sum should accrue to the also-captured other person --the injured-one !
