(SACRAMENTO, CA) - Doug and Sarah Sinclair have been fighting for the well being of their children from a distance, unable to cause a Salford County Court District judge to understand that she is making a regrettable mistake with heartbreaking, avoidable consequences. "Our daughter Summer was three years, five months, our son Jack was two years, three months, when they were stolen. They have reported being abused physically, and emotionally by the foster caregivers and their two teenage sons, aged 14 and 16. "The eldest has hit, kicked, and called our daughter a bastard and told her no one likes her, she has also said that the foster care provider has hit her." Bear in mind that their daughter and son are tiny defenseless human beings, and foster family horror stories abound; of physical, sexual and emotional abuse. Cruelty, indifference, dark sarcasm and threatening behavior can destroy a small child emotionally, aside from the fact that they have ripped away from their mummy and daddy without cause at a most critical stage in their lives. Authorities from social services (CPS in many US states) seized their kids on shoddy, unfounded evidence on 18th January 2012. With striking similarities to the Musa case in the UK which I have written about, authorities apparently refuse to admit their judgement error, and for Doug and Sarah and their two little ones, Summer and Jack, an unimaginable nightmare drones on. The couple explains that their entire ordeal is based upon anonymous referrals by malicious neighbors. Now they are fighting for their children's safety and future. Doug Sinclair told Salem-News, "The local authority cited drug and alcohol misuse, then they took our two children into care, and placed them with foster carers, based on Emotional abuse, or Future risk of emotional abuse." He says they began to realize the extent of corruption in the child care system after involuntarily being plunged into the depths of it. They were shocked over the tactics used to secure child placement for adoption; stories we so frequently hear in the US. "The only assessment we had was a revised core assessment, which we had separately because the local authorities refused to accept we were a married couple. "Despite us supplying them with a copy of our marriage certificate, they refused to allow us to be assessed together. We have never had a joint contact with our children, and the assessment was based on hearsay, lies, assumption and presumption, and very little fact, which was all accepted by the judge, despite the FACT we had evidence to disprove it all," Doug Sinclair said. During the course of the proceedings, in April 2012, Doug's wife discovered she was pregnant. When social services learned she was pregnant they called her into the office and told her they would be making an application to take the baby into care the moment it was born. This led to a heartbreaking decision, which Doug and Sarah say went against all their beliefs. The pregnancy was terminated. It seems officials are doing nothing but harm to this family. Doug Sinclair says a social worker was putting immense pressure throughout the proceedings for his wife to file divorce and move out of the couple's lovely home, go into a hostel, which the Sinclairs say are full of drug addicts and alcoholics. Yet the judge in the case, District Judge Louise Relph, has a reputation of being the "Adoption Queen". The couple believes Relph was very biased throughout the case. They were not allowed to have independent assessments or an independent social worker. They were denied access to psychological assessments. Doug Sinclair said, "We were not allowed to call witnesses so we could not challenge the evidence and the allegations made towards us, we were not even allowed to have a finding of fact hearing, which would have, outlined the facts only." "Our counsel pointed out flaws and gaps in the core-assessment, which was totally ignored by the judge... the case was a white-wash." It got progressively worse according to Sinclair, "Before the final hearing got underway, we were both advised by our legal teams to, agree to the adoption before-hand, and in doing so the judge would write in her judgement that we were very loving parents and we did it for the sake of the children, but if we didn't agree to it and the hearing went ahead, the judge would write something very different indeed. Naturally we went ahead with the hearing." Legal aid in the UK has recently changed, and it is very difficult to get funding for legal representation. Doug Sinclair added, "After the 3-day hearing, in which the social worker spent most of her time, under oath and cross examination, rubbing her bump, because she was pregnant, (and would have given birth around the same time as my wife), the decision was made to place our children for adoption. "We have already launched one unsuccessful appeal, and are know trying to launch another appeal with the Royal Courts of Justice. Failing that we will try to take the case to the ECHR (European Court of Human Rights in Strassburg)... but this process is very difficult when we have no legal representation." The very worst thing, beyond the immeasurable pain of this family being ripped apart, is the fact that the Sinclair family has very serious concerns for their children in their current placement. One horror story that followed, involved a foster care family taking the Sinclair's daughter to school on a cold and frosty morning with no coat on, and on another occasion they left the Sinclair's son in the car alone whilst the "foster mom" took their daughter into school. Sarah Sinclair say this is gross, willful, neglect. "Our son has reported to his dad he was punched in the stomach, he also now has a 2-inch scar on his forehead where the foster carers' son pushed him over. He has also told his dad the foster carers allow him to play in the garden pond. When we raised these issues, they said our child was being cruel, manipulative ans spiteful and was lying." The foster care providers claimed that the scar on the boy's lip was caused by Sarah Sinclair, when in reality it was caused by a fall in the garden, this was witnessed by a close family friend. According to the foster care providers, Jack said "Mummy did it, she punched me in the mouth." But Sarah Sinclair said, "Our son can't say full sentences." The foster family said, "Oh well, I may have added that bit on the end." Doug and Sarah Sinclair say they have this on voice recording. "We also have a voice recording admitting that what they have done to our children is emotional abuse." After this, the couple started secretly recording all meetings, telephone conversations and more recently contacts with the children. Then it was discovered that the daughter of Doug and Sarah Sinclair had been diagnosed with a potentially life-threatening heart condition; something the foster family had known for three months. "In fact, she only told us the day before our children were due to fly out on holiday to Italy," Sarah Sinclair added. As the family nightmare continues, Doug learned on April 22nd at a contact review, that his contacts have been suspended and his wife's reduced from once a month to once every 2 months, "because our children are not coping in foster care." This video [now disabled by YouTube] was produced without disclosing the identities of Doug and Sarah Sinclair, however their concern about not being identified has rescinded as they only care about regaining custody of their children. This is a sound, loving couple. The judge needs to toss this case out and bring this family back together. _________________________________________
