Supreme Court Rejects Citizens' Request to Change Nationality from 'Jewish' to 'Israeli'

Court rules against change in identity card registration, citing that there is no proof of the existence of a uniquely 'Israeli' people.

(TEL AVIV Ha'aretz) - Israel's Supreme Court on Wednesday rejected a request by a group of Israelis to declare that they were members of the Israeli people and to allow them to change the ethnic registration on their identity cards from “Jewish” to “Israeli.”

The court ruled that the issue was not one for the court to decide and that there was no proof of the existence of a uniquely “Israeli” people. The court’s ruling echoed that in a similar case 40 years ago.

The decision by court President Asher Grunis and Justices Uzi Vogelman and Hanan Melcer upheld the 2008 ruling by their colleague, Noam Sohlberg, who, as a Jerusalem District Court judge, had rejected the group’s petition.

Israel does not recognize “Israeli” as an ethnic group [in Hebrew le’om.] The term can be translated into English as “nationhood,” but in the sense of ethnic affiliation, rather than citizenship. The le’om attrribution - the main ones are “Jewish” and “Arab” - is assigned by the Interior Ministry, regardless of the card-bearers preference.

The main appellant was Prof. Uzzi Ornan, a linguist who has long battled to separate religion and state. Ornan, 90, was born and raised in Jerusalem. He was expelled to Eritrea in 1944, when his underground activities were revealed to the British authorities. When he returned to Israel in 1948, he was registered in the state’s first census and insisted that he not be listed as “Jewish.” Instead, he wrote that he was of no religion and gave his ethnic designation as “Hebrew.” The newly-formed Interior Ministry accepted this without question.

In 2000, Ornan petitioned the Interior Ministry to be registered as an ethnic “Israeli,” but his request was rejected and none of his subsequent legal actions were successful. In 2007, he submitted another appeal to the Jerusalem District Court, together with Uri Avnery, Shulamit Aloni, Prof. Itamar Even-Zohar, Prof. Yosef Agassi, singer Alon Olearchik, playwright Joshua Sobol and others.

In his ruling rejecting the appeal, Sohlberg stated, “the requested declaration has a public, ideological, social, historic and political character – but not a legal one. This isn’t a technical issue of registration in the Population Registry, but a request that the court determine that in the State of Israel a new peoplehood has been formed, common to all its residents and citizens, called ‘Israeli.’ This issue is a national-political-social question and it is not the court’s place to decide it.”

The group argued in its appeal that an Israeli people was formed with the establishment of the State of Israel and that rejecting the existence of such a people is like rejecting the existence of the State of Israel as a democratic, sovereign state. They added that this was indeed a legal question that the courts could not avoid. In their response, the Interior Ministry and the attorney-general supported the district court decision, saying the issue was not justiciable.

The primary precedent on which the justices based themselves in their ruling Wednesday was the case of Dr. Georges Tamarin, who immigrated to Israel in 1949 from Yugoslavia. He was registered as being of Jewish ethnicity, but in the religion section was listed as having no religion.

In 1970, after a change in the law that forbade listing someone as being “Jewish” in either the ethnicity or religion section if he didn’t meet the description of a Jew in the Law of Return, Tamarin went to court to change his ethnic designation to “Israeli.” Both the Tel Aviv District Court and the Supreme Court rejected his request, stating that for a person to declare that he belongs to a given ethnic group, there had to be proof that the group exists. Court President Shimon Agranat stated that “there is no significance to the person’s subjective feeling of belonging to a given ethnic group, without being able to establish via any criteria that such a group exists.”

Ornan expressed his disappointment with the ruling. “In its ruling the court, in effect, agrees to totally ignore the obligations included in the Declaration of Independence, which promises full equality among all the state’s citizens, regardless of religion, race or gender,” he said.

“The government consensus that has developed ignores the existence of an Israeli people that was created with the Declaration of Independence,” Ornan continued. “This consensus enables the Jewish majority to have full control over the country and to operate not for the benefit of Israeli citizens but for the benefit of the current political majority among the Jews.”

Hebrew Isrealites are group of people who follow the scriptures that were written through the prophets of Yah(G_d), however it is scriptural fact and through archeology that the so called African American / Caribbean "Black Man / Woman" is the descendant of the biblical Israelites. "Descendants of Abraham, Isaac and Jacob". We do believe in the Torah which is the foundation of the most high and the instructions that was given to the children of Israel. We also do follow the leviticul code that is mention in Leviticus chapter 11. This chapter clearly explains on what to eat and what not to eat.(unclean and clean animals)

And NO... we are not racist nor do I or others that I know of preach or teach black superiority or hate. For someone to accuse that "all Hebrew Israelites are racist" is like saying that every white person is racist and is a member of the KKK. A person with a little bit of common sense will know that every white person is not racist, so one cannot assume or accuse something that is considered false.

The scripture in Deut 28:15-68 clearly explain the curses upon Israel for the breaking Yah's laws and worshiping other G_ds. There are several prophecy's throughout the old and new testament of Israel being scattered throughout the four corners of the earth. The temple that you see today in Jerusalem is prophecy fulfilled and it was destroyed in 70 AD by the Romans, which has scattered all the 12 tribes of Israel into Africa and then in later time as per prophecy mentioned in Deut 28:68, the Israelite s were sold into slavery...According to the prophecy mentioned in Deut 28:68, the only race of people who were sold into slavery by ships (bond men and bondwoman) were black people, as per scripture are the true descendants of the biblical Israelite's

The so called Jews and/or Israelis that you see in Israel today are not the descendants of the Biblical Israelites, however does make you wonder why they don't call them selves Israelites, becuase the truth is knowed that Israel became a state after 1948 through the assistance of the United Nations after world war 2. These so called Jews in Israel today are impostors who lie about being the descendant of the biblical Israelites. 92% of the white jews that you see today are Ashkanazi's from the khazar empire, from the European region. They also believe in the Talmud, which is to them considered higher than the bible. This Talmud (oral law of Moses) is nothing but a book of hate and immorality. The Talmud is no where where mentioned in the Holy bible nor is it mentioned in theTanak (Torah) The word Judaism is also not mentioned in any of the scriptures or in the Tanak.

Unfortunately there are different sects of Hebrew Israelite groups that are only Torah based and other groups that do believe in the Torah, new testament and the Apocrypha.

Hebrew Israelites is not a religion, its a nation of people that came from the descendants of Jacob, which formed the 12 tribes of Israel. - See Genesis 35:11

Catholicism, Judaism and Islam all adhere to an individual such as a prophet, Rabbi or Pope…which does fall into a category of being a cult…We Hebrew Israelites only follow YAH (G_d) / Yehoshua (AKA Jesus) and nothing more…We study and follow the scriptures only.

Unfortunately not all Hebrew Israelites are all one accord and they are different groups within the Hebrew Israelites. For example, The ones you see in Times square or on the streets is (ISPK) Israel School of Universal Practical Knowledge or (USPK) United school of practical knowledge. The ones that I met from this group are to the extreme. They are misinformed about the true message of the Messiah. It's all about showing love and teaching salvation to another human being. (no matter the what color the person is)...I have come across many white Hebrew Israelites that are aware of the truth (in America and in Europe) and I find that to be a beautiful thing.....Salvation is for everyone (Yah is no respecter of persons and he does not care what color the person is, as long as they aware of the truth and what he requires)....Also we do not tolerate evil or lies that is being taught from other religions or cults....The Jews that you see today in Israel is a lie and right now the truth is coming to the world about this lie....

They CANNOT provide any evidence through Archeology or through the Holy Scriptures on their claims on being the Chosen ones and/or being the descendants of the ancient Biblical Israelites..IF I'M WRONG..I would kindly ask anyone to please email me the evidence, especially evidence that can be provided through the HOLY SCRIPTURES (The Bible) or better yet, I would suggest for the individual to post this solid "STRONG"credible Evidence as it would be considered the "Best Answer" that would undoubtedly prove me and every Hebrew Israelite in this forum wrong, however the information that we have provided, is derived from the HOLY SCRIPTURES and through historical facts. So overall the only group that I know of that portrays hate, that is to the extreme is ISPK or USPK. I really don't know if your friend belongs to one of those two groups...The only way to find out is to ask.

As for you question regarding other races going to hell ? The answer is no, however Yah(G_d) did choose the Israelites to be of a Holy people (set apart nation) to teach salvation unto the other nations. The other races as per scripture will have to be grafted unto the nation of Israel to receive salvation..

I would recommend do read Paul's writings in the new testament, he is a perfect example of an Israelite teaching other "gentile" nations the gospel (good news of the salvation of Yahausha "AKA - Jesus") He taught the gentiles on how to become grafted unto the nation of Israel.
