Investigators interviewed several witnesses who stated they saw Bollea and Daniel Jacobs racing, before Bollea lost control of the his vehicle and crashed into a tree.

Investigators have determined Bollea was driving in excess of 60 miles per hour close to or at the time of the crash. The posted speed limit in that area is 40 miles per hour. The road was also wet due to a recent rain shower.

Graziano, a Marine who had just completed a tour of duty in Iraq, remains hospitalized, reportedly in a coma.

"Nick and the entire 'Hogan' Bollea family are saddened that criminal charges have been filed in regards to the tragic single car accident on August 26, 2007," the family said in a statement. "Nick will meet and answer these charges in the appropriate arena -- a court of law."
