The defendants are also charged with six counts of Burglary in the First Degree.
(THE DALLES) - Police say a third person was arrested this weekend in relation to the May 25th death of a man in The Dalles.
Police officers arrested 18-year old Francisco Enriquez Ibarez of The Dalles, on a warrant issued by Wasco County Circuit Court Judge John Kelly. The warrant was issued after the Wasco County Grand Jury returned indictments against defendants Enriquez Ibarez, Jamia Long and Selu King for recklessly causing the death of Bernardino Peral Sanchez on May 25th 2008.
The three indictments allege that the three defendants acted recklessly in causing the death of Sanchez. The indictments are nearly identical and the three men are considered co-defendants. The State plans to file motions to join the three cases for trial.
Wasco County District Attorney Eric Nisley stated, "It would be inappropriate for me to release factual details, but these allegations are based on the principle of law that when one or more persons have the intent to promote or facilitate commission of a crime, and the accused aided or abetted in the commission of the crime, all are responsible for the acts of each other."
District Attorney Nisley stated the most commonly understood example of this principle is that the driver of the getaway car in a bank robbery is just as guilty of robbery as the person who points the gun at the bank teller. The same is true of the bank robber who shoots the teller—the driver is also guilty of homicide.
The defendants are also charged with six counts of Burglary in the First Degree. The charges allege that each defendant entered the victims residence with the intent to commit the crime of assault against multiple victims.
Ibarez was arrested on a warrant for Manslaughter in the Second Degree, 6 counts of Burglary in the First Degree, and Assault in the Third Degree. He was located and arrested in Hood River. Ibarez was transported and lodged at NORCOR and is to appear, via video arraignment at 1:00 PM.
